Our investor-state dispute settlement team has unparalleled experience as counsel to governments in investment treaty arbitrations, acting as counsel or senior advisor in over 30 investment treaty arbitrations, and defending claims ranging from $20 million to $2.3 billion in damages. Members of our team have acted as counsel to the Government of Mexico in all of its investor-state arbitrations since 1997. They have also advised on the negotiation and implementation of bilateral and multilateral investment protection treaties and the application of international investment obligations to, inter alia, public-private partnerships, health services, telecom services and cultural industries.

We understand the complexities of international investment law and the forces that have shaped its evolution over the past two decades. Our lawyers’ experience began during the early stages of development of this law and extends to the most recent developments introduced in the Canada-EU Comprehensive Economic and Trade Agreement (CETA) and the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP). We have direct experience with the interface between investment rights and obligations and those under international trade agreements relating to cross-border trade in goods and services and foreign direct investment. Our lawyers appeared as legal counsel in the only completed disputes involving parallel trade and investor-state proceedings: the case of Mexico – Soft Drinks before the WTO and three related investor-state arbitrations, Archer Daniels Midland Company et al, Cargill Inc., and Corn Products International, Inc. v. United Mexican States.

We also advise investors on their rights under investment treaties and how to structure their foreign direct investments to benefit from the protection accorded under investment treaties.

Our experience in analyzing investment rights, obligations and procedures from both government and claimant perspectives forms the foundation from which we represent our clients in investment matters.
