Trade Agreements Negotiations, Implementation and Interpretation

Tereposky & DeRose provides experience and expertise in trade negotiations, the implementation of trade agreements into domestic law and trade agreement analysis. We represent governments and government departments on both agreement-wide and specific subject matter issues. We advise private sector clients on issues that affect their industries or businesses. We assist clients in the legal “scrubbing” process that occurs after the negotiations are complete and the subsequent implementation of the final legal texts of trade agreements into Canadian domestic law.

Our lawyers’ experience in trade negotiations spans over 30 years, dating back to the implementation of the Canada-United States Free Trade Agreement in 1989, the policy discussions that led to the initiation of the trilateral negotiations for the 1994 North American Free Trade Agreement (NAFTA), the NAFTA negotiations, and elements of the Uruguay Round of negotiations leading to the 1995 World Trade Organization Agreements, including in the areas of agriculture, anti-dumping and subsidies and trade-related investment measures.

Our representative work includes:

  • Acting as counsel to Mexico during the NAFTA negotiations
  • Advising clients on regional trade agreements negotiated by Canada
  • Preparing a comprehensive legal analysis of the Canada-EU Comprehensive Economic and Trade Agreement for the European Commission
